By accessing or using Factorcast.com ("Factorcast", "we", "us", or "our"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not use our service.
Factorcast provides an AI assisted platform that allows users to generate videos from text content ("Service"). Users can download the generated videos or embed them on their own websites.
To access certain features of the Service, you may be required to create an account. You are responsible for safeguarding your account information and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account.
You are solely responsible for the text and other content you submit to the Service ("User Content"). You represent and warrant that you have all necessary rights to your User Content and that it does not violate any third-party rights or any applicable laws.
You agree not to use the Service to create any content that is unlawful, harmful, threatening, abusive, harassing, defamatory, vulgar, obscene, or otherwise objectionable.
We do not claim ownership of your User Content. However, by submitting User Content to the Service, you grant us a worldwide, non-exclusive, royalty-free license to use, reproduce, modify, and process the User Content solely for the purpose of providing the Service to you.
The Service and its original content (excluding User Content), features, and functionality are and will remain the exclusive property of Factorcast and its licensors. The Service is protected by copyright, trademark, and other laws of both Czechia and foreign countries.
Certain features of the Service may be subject to payment. You agree to pay all applicable fees in connection with your use of the Service. All fees are non-refundable except as required by law.
We may terminate or suspend your access to the Service immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach the Terms.
Upon termination, your right to use the Service will immediately cease.
The Service is provided on an "AS IS" and "AS AVAILABLE" basis. We make no warranties, express or implied, regarding the operation or availability of the Service.
In no event shall Factorcast, nor its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from your access to or use of or inability to access or use the Service.
These Terms shall be governed and construed in accordance with the laws of Czechia, without regard to its conflict of law provisions.
Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights. If any provision of these Terms is held to be invalid or unenforceable by a court, the remaining provisions of these Terms will remain in effect.
We reserve the right, at our sole discretion, to modify or replace these Terms at any time. We will provide at least 30 days' notice prior to any new terms taking effect. By continuing to access or use our Service after those revisions become effective, you agree to be bound by the revised terms.
